Hearing set June 9 on opening documents in Flack murder trial
OTTAWA — District Judge Eric Godderz has scheduled a hearing for June 9 in Franklin County District on whether to open up certain court documents in the capital murder trial of Kyle Flack. The hearing is response to a motion by the Ottawa Herald to intervene in the case and to open sealed court documents in the case. In his filing, the paper’s attorney Maxwell Kautsch said the decision to close the documents doesn’t meet the standards set by the Kansas Supreme Court and the Legislature. Because of secrecy surrounding the trial, it’s not always clear what sealed motions have been filed in the case, he said. Neither prosecutors nor glack’s attorneys have clearly proved that the release of the documents would jeopardize flack’s right to an impartial jury or a fair trial, Kautsch said. Previously, news organizations have filed suit to open various hearings and documents in the case. Flack is charged with killing Kailie Bailey, her 18-month-old daughter Lana Leigh Bailey, Andrew Stout and Steven White two years ago near Richter.
