Prison inmate, county attorney duel over request for third kidnapping, attempted rape trial

TOPEKA — Prison inmate Ralph Corey and the Franklin County Attorney’s office skirmished in filings and counter filings to the Kansas Supreme Court Thursday and Friday.  Corey, who was convicted twice of aggravated kidnapping, attempted rape, two counts of aggravated sexual battery, and criminal threat involving a 15-year-old cold case, is seeking a third trial.  Corey argues that there is a mistake in the trial court record and he should get a re-trial.  In his written motion, deputy county attorney Josh Smith said the mistake is minor and wouldn’t affect the outcome of Corey’s second trial.  He is seeking that the case be sent back to Franklin County District Court so the record can be formally corrected.  Smith also requested that the high court delay a deadline set for Friday for filing a motion concerning the case.  In a counter-filing, Corey expressed opposition to both requests, saying the county hadn’t bothered to correct the document and that the mistake was serious enough to warrant a retrial.  Corey was convicted of kidnapping a then-teen girl from Williamsburg from the Wal-Mart SuperCenter parking lot and trying to rape her.  The first trial was ended on a mistrial, after a juror used a smart phone to get additional information on the incident.  An earlier attempt by Corey for a retrial was rejected by the state appeals court but the high court agreed earlier this month to review the case.  Corey, a former truck driver, was in prison in Arizona for a sex crime when a new KBI computer program matched his DNA to evidence in the Ottawa case.
