Judge leaves slight possibility of moving murder trial out of Franklin County

OTTAWA — District Judge Eric Godderz has left the door ajar to a request to move the capital murder trial of Kyle Flack outside of Franklin County.  Previously, Godderz rejected a motion by Flack’s attorneys to move the trial because of what they described as prejudicial pre-trial news coverage of the murders and the trial.  Flack is charged with killing Kaylie Bailey, her 18-month-old daughter Lana Leigh Bailey, Andrew Stout, and Steven White at Stout’s farm near Richter two and a half years ago. Prosecutors filed their intention to seek the death penalty for Flack if he’s convicted.  During Wednesday’s status hearing, Godderz and defense attorney Tim Frieden discussed the possibility of moving the trial depending on how difficult it was to find acceptable jurors.  About 700 people could be called as potential jurors, with three weeks set aside for selecting a jury.  The trial is scheduled to begin Feb. 22.  Flack’s next court appearance will be Nov. 24.
